Why both names
Why is my roof check made out to me and my mortgage company?
Mortgagee on the check
When you have a mortgage, the insurer often makes the claim check payable to you and your lender (or servicer), because the lender has a financial interest in the home.
Loss draft department
The servicer's team that handles insurance checks. It may endorse and return the check, or hold the funds and release them in stages as repairs are done and inspected.

The process
What are the steps?
1. Endorse the check
Sign it yourself, then follow your servicer's instructions for sending it in.
2. Send the paperwork
Usually the adjuster's estimate, your signed roofing contract, and any forms the servicer requires.
3. Get funds released
Some servicers release everything for smaller claims; others release in stages after inspections.
4. Close out
Send the final invoice and any lien waiver the servicer asks for.
If the servicer stalls
Ask for its written requirements and the reason for any delay. You can submit a complaint to the CFPB.

Deposits under Colorado law
Colorado's roofing law requires a written contract stating, in bold, that the roofer holds your payments in trust until materials are delivered or most of the work is done. You can also cancel within 72 hours of signing, and within 72 hours of a written claim denial.

The deductible is yours
Colorado law bars roofers from advertising or promising to pay, waive or rebate any part of your deductible (SB 12-038).

Why is my insurance check made out to my mortgage company too?
Your lender has a financial interest in the home, so insurers often list it on claim checks. You and the servicer both endorse.
How do I get my mortgage company to release the roof money?
Endorse the check and follow your servicer's loss-draft instructions. They usually want the adjuster's estimate and your contract, and some release funds in stages after inspections.
What if my servicer won't release the funds?
Ask for written requirements and reasons. You can submit a complaint to the Consumer Financial Protection Bureau.
Can the roofer pay my deductible?
No. C.R.S. 6-22-105 bars it.
